Tyson Loses Donning Doffing Appeal

US - A Tenth Circuit panel last week rejected attempts by Tyson Foods to reverse a $4 million verdict and attorneys’ fee award in an employee class action over unpaid wages for time spent putting on protective equipment.

The court found that there was enough evidence to support the jury’s finding.

The panel ruled that a Kansas federal jury that awarded workers more than $500,000 in damages in 2011 was correct in inferring regular underpayments.
